    False Imprisonment

    We were asked this question in one of our lectures. Does consciousness or knowledge of confinement constitute false imprisonment. Assist with caselaws. Thanks.

    This excerpt from Lunney and Oliphant's Tort Law should help you out.

    Page 65 states that knowledge of imprisonment is not necessary to bring an action, but may be a criterion in assessing damages.
