Per incuriam translates as 'through lack of care', i.e., a judgment made ignorance of, or without reference to, an existing, relevant statutory provision or earlier judgement. Which term describes the opposite of this, i.e., a judgment made assuming a law to exist but did not? And have you any examples in proof of same?
